Amen SD se pronuncia sobre el fallo de la CIJ de La Haya

El Movimiento Amen SD (Archipelago Movement for Ethnic Native Self-Determination) se pronunció oficialmente sobre el fallo proferido por la Corte Internacional de Justicia (CIJ) del 19 de noviembre de 2012 y todas sus consecuencias geopolíticas, ambientales, económicas, históricas y culturales. Declaración del Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina sobre el fallo de la Corte Internacional de Justicia en el Caso de Nicaragua contra Colombia.

1º. El Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina, toma acta del fallo de noviembre 19 de 2012 proferido por la Corte Internacional de Justicia-CIJ en el caso de Delimitación Territorial y Marítima de Nicaragua contra Colombia, expresando su consternación y rechazo a esa decisión, como también nuestra firme determinación para luchar sin descanso por nuestro Territorio Ancestral, con el cual nos adherimos a la Nueva Granada en 1822 y que aún nos sigue perteneciendo.  

2º. El Pueblo Indígena Raizal del Archipiélago San Andrés, Providencia y Santa Catalina asiste impávido al despojo de una parte considerable de su espacio marítimo, sin haber consentido jamás su participación en el proceso que generó esa decisión y sin haber podido expresar su voz en él.

3º. Sabido es que las potencias coloniales partían etnias, macro sistemas, ecosistemas y sistemas geográficos al capricho de reglas y compas en América, África, Asia y Oceanía, dejando en gestación conflictos que asumieron, en algunos casos, connotaciones sangrientas varias décadas después.

4º.- Si bien hay que reconocer notables progresos, el derecho internacional de la delimitación adolece hoy de una grave deficiencia estructural al no permitir voz, participación ni reconocimiento de derechos a los pueblos indígenas respecto de los cuales los Estados, en la mera dinámica de las soberanías se juegan solos entre ellos la delimitación de lo que consideran como “sus territorios”.

5º. Esa es una grave falencia que es preciso corregir en el derecho internacional. La CIJ debe abrirse a la expresión de los pueblos indígenas concernidos por la delimitación, a quienes la comunidad de naciones reconoce como sujetos de derecho internacional.

6º. El Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina registra que aún hoy, avanzando el siglo XXI, el fallo de la CIJ, en el cual se admite que “ la delimitación no es una ciencia exacta” y bajo el ropaje de una supuesta equidad que el pueblo Indígena Raizal no ve por parte alguna, cercenó el espacio marítimo que durante siglos ha sido parte esencial de nuestro Archipiélago, del entorno de las Islas que lo conforman, de la cultura, de los universos simbólicos y de los medios de subsistencia del Pueblo Indígena Raizal.

7º. En un trazado de delimitación caprichoso o “barroco” como dejó consignado un Juez ad hoc, el fallo de la CIJ cercenó la unidad geográfica, oceanográfica, ambiental y cultural de una zona reconocida como Reserva Mundial de la Biosfera “Seaflower”, por una Organización de las Naciones Unidas, no solo seria y respetable, sino también generadora de normas frente al derecho internacional como es la UNESCO.

8º. El Pueblo Indígena Raizal no guarda resentimiento alguno hacia el Pueblo hermano Caribe de Nicaragua y participará activamente en los procesos de implementación del fallo de la Corte con espíritu de cooperación y velando por la preservación de la Reserva Mundial de la Biosfera y los intereses de nuestro Pueblo, principalmente los pescadores, en una actitud fraternal y buscando la solución pacífica de los conflictos que puedan surgir, pero debe dejar registrado ante la historia, que no puede aceptar el cercenamiento del espacio marítimo, espacio territorial y nuestra cultura, que es parte inherente del Archipiélago.

9º. Es claro que el Estado Colombiano deberá asumir las responsabilidades que le corresponden por esa pérdida para el Pueblo Indígena Raizal.   

10º. El Pueblo Indígena Raizal, es un Pueblo pacífico, dispuesto a la cooperación, respetuoso de la ley y del derecho. Así ha sido en nuestra relación con Colombia y así será con respecto al derecho internacional.

11º. Por ello, el Pueblo Indígena Raizal asume hoy el compromiso histórico de luchar sin descanso por mantener y preservar el espacio marítimo y terrestre, que es parte inherente e indivisible del Archipiélago, del entorno ambiental y geográfico, de los recursos de subsistencia del Pueblo Indígena Raizal y de su universo cultural, para lo cual recurrirá a todos los mecanismos que le brinda el derecho internacional, principalmente la Carta de las Naciones Unidas, los Pactos de Derechos Humanos, La Convención Americana de Derechos Humanos, el Convenio 169 de la OIT sobre Pueblos Indígenas y Tribales en Países Independientes de 1989, la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas, las normas consuetudinarias del Derecho Internacional del Mar y expresará su voz en todos los foros y organismos internacionales donde se le reconozca como sujeto de derecho internacional.

12º. El Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina, elegirá libre y autónomamente de entre sus miembros a quienes lo representarán en esos espacios, sin injerencia del Gobierno Colombiano, ni de partidos políticos, ni de ninguna otra autoridad diferente al Pueblo Indígena Raizal.

13º. Finalmente el Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina pide al gobierno actual de Colombia hacer muestra de madurez política y de una mejor comprensión de los problemas internacionales, en particular de las garantías que nos brinda el derecho internacional que nos reconoce como pueblo y exigimos al mismo tiempo, con firmeza y determinación, que el estado colombiano haga cesar inmediatamente las violaciones a nuestros Derechos Ancestrales sobre nuestras tierras, territorio y recursos naturales, haga cesar el espionaje y la represión que han desarrollado organismos de seguridad de ese estado, alguno de desastrosa recordación como el disuelto DAS, cuyos informes no hacen sino evidenciar y confirmar una política colonialista de varias décadas por parte de Colombia hacia un pueblo no violento como es el nuestro, política que ataca nuestra práctica del culto protestante, del inglés creole, nuestro derecho a la etno-educación, a nuestras tradiciones y a nuestra especificidad cultural, promoviendo a la vez como política de estado, de forma irresponsable que rompe todos los estándares sobre equilibrio ambiental, el sobre poblamiento de las Islas, todo lo cual constituye una clara violación a nuestros derechos fundamentales y en definitiva, una política colonialista que rechazamos tajantemente.

El Pueblo Indígena Raizal del Archipiélago de San Andrés, Providencia y Santa Catalina no es un peligro para Colombia, como torpemente se pretende hacer creer. Frente al derecho internacional, más peligrosa y de graves consecuencias para Colombia resulta la política colonialista y de sobre poblamiento que se nos ha venido aplicando desde hace varias décadas; el desconocimiento solapado y la vulneración abierta a los derechos fundamentales de nuestro pueblo; como también la pérdida negligente de una porción considerable de nuestro espacio marítimo, de donde devengamos nuestro sustento.

Somos un pueblo pacífico, pero al mismo tiempo somos un pueblo que sabrá luchar por sus derechos, sobre todo donde Colombia no ha sabido hacerlo.

DECLARATION OF THE RAIZAL INDIGENOUS PEOPLE OF THE ARCHIPELAGO OF SAINT ANDREW, OLD PROVIDENCE AND SAINT CATHERINE. IN REGARDS TO THE INTERNATIONAL COURT OF JUSTICE IN THE CASE OF NICARAGUA AGAINTS COLOMBIA.

 

1.The Indigenous Raizal People of the Archipelago of Saint Andrew, Old Providence and Saint Catherine takes account of the sentence of November 19, of 2012, issued by the International Court of Justice-ICJ in the case of Territorial and Maritime Declaration against Colombia, expressing our deep consternation and rejection to that decision, as well as our firm determination to fight without rest for our territory that was adhere to the Nueva Granada in 1822 and continue  belonging to us.


2.The Indigenous Raizal People of the Archipelago of Saint Andrew, Old
 Providence and Saint Catherine witnessed with astonishment the expropriation of a considerable part of our Maritime space, without consenting at anytime our participation in the process that brought forth that decision and without being able to express our voice in it.


3.It is known that The Colonial powers  are accustomed to divide up Ethnic groups, Macro-systems, Ecosystems, and Geographical systems to their own will in America, Africa, Asia and Oceania, leaving  conflicts in process that resulted, in some cases, in violent confrontation that lasted for several decades after.


4.If, as a matter of fact we have to recognize some important progress, the International Rights of delimitations is locking today of a serious structural deficiency by not permitting the voice, participation nor recognition of the Rights of the Indigenous  People in regards to whom The States, in the only dynamic of the sovereignties only among themselves exercise the delimitation of what they consider “Their Territories”.


5.That is a serious error which is necessary to correct in the International Rights.  The ICJ must open the possibility to the expression of the Indigenous People in regards to the delimitation to whom the community of nations recognize as subjects of International Rights.


6.The Indigenous Raizal People of the Archipelago of Saint Andrew. Old Providence and Saint Catherine, register even today advancing in the twenty first century, the sentence of the ICJ, in which it is admitted, “Delimitation is not an exact science” and under the category of a suppose equity that The Indigenous Raizal People do not see anywhere it cut into pieces the maritime space that for centuries has been an essential part of our Archipelago of the environment that conform it, of the culture of the symbolic universes and of the means of the subsistence of the Indigenous Raizal People.


7.In an irrational or “Baroque”, delimitation as an Ad Hoc judge made the remark, the sentence of the ICJ, broke the geographic, oceanographic, environmental and cultural unity into pieces of a well recognize zone such as The “Sea flower Biosphere World Reserve”, done by an organization of the United Nations, not only serious and respectable, but also generator of norms, before the international Rights which is UNESCO.


8.The Indigenous Raizal People do not hold resentment of any kind towards the Caribbean brothers of Nicaragua, and will participate actively in the processes of the implementation of the sentence of the court with a spirit of cooperation and with the effort to preserve the World Biosphere Reserve and the interest of our People, mainly those of the Fishermen, in a fraternal attitude and searching for a peaceful solution of the conflicts that could arise, but it should be registered in the History, that we cannot accept the splitting up into pieces of the Maritime Space, territorial space and our culture, which is an inherent part of the Archipelago.


9. It is clear that the Colombian state shall assume the responsibilities that correspond to it, cause by the lost of the Territory of the Raizal People.


10.The Indigenous Raizal People is a peaceful people with a disposition to cooperate, respectful to law and order that is how it has always been in our relation with Colombia, and so it shall be in relation to the International rights.


11.For this reason, the Indigenous Raizal People assume the historic commitment to struggle without rest in the order to maintain and preserve the Maritime and Territorial Space, which is an inherent and indivisible of part of the Archipelago, of the environmental and geographic context, of the survival resources of the Raizal People, and of her cultural universe, for which means; will make use of all the mechanisms that the International Rights provide, mainly the Chart of the United Nations, the Human Rights Agreement, the American Convention of  Human  Rights, Convention 169 of the ILO, on Indigenous and Tribal Peoples In  Free Countries of 1989, the United Nations Declaration on the Rights of Indigenous People, The Habitual Norms of The International Rights of The Sea, and we will express our voices in all the forums and International Rights of the Sea, where we are recognize as subjects of International Rights.


12.The Indigenous Raizal People of Saint Andrew, Old Providence and Saint Catherine, will freely and autonomously elect among our members those who will represent The Ethnic People in those Spaces, without the interference of the Colombian Government, neither the Political Parties, neither from any other Authorities different from The Indigenous Raizal People.


13.Finally, The Indigenous Raizal People of Saint Andrew, Old Providence,Saint Catherine, request from the Colombian Government to show examples of Political Maturity and a better comprehension of The International Problems, especially, in regards to the guarantees that are provided by The International Right that recognizes us a People and we demand, at the same time, with strength and determination, that The Colombian State stops immediately  the violation of our Ancestral Rights, in our Lands, Territory and Natural Resources, stop spying on our Lands, Territory and Natural Resources, repression that has been developed by State Security Organism, some of disastrous remembrance, such as the dismantled, “DAS”, whose reports only give evidence and confirm a Colonialist power for several decades, carried out by Colombia, towards a non violent People as Ours, Policy that attacks the practice of our Religious Protestant Worship, the use of our Creole English, Our rights to Ethnic Education, to our traditions, and to our cultural specificity, promoted hand in hand as a State Policy, in an irresponsible way breaking all the standards on environmental equilibrium, overpopulation of the Islands, all what constitutes a clear violation to our fundamental rights and in summary a Colonialist Policy, that we reject categorically .

 

The Indigenous Raizal People of Saint Andrew, Old Providence, and Saint Catherine, is not a threat for Colombia, as it is presented in a very awkward way to make it believable.  Before The International Rights it is more dangerous and of more serious consequences for Colombia it results as a Colonial Policy and the overpopulation that has been applied on us, for several decades; the underground denial and the open violation of the Rights of our People; as well as the negligent lost of a substantial portion of Maritime Space, from which we get our daily support.
